1. Acceptance of Terms

By accessing or using the BioFit mobile application and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and BioTrac LLC ("BioFit," "we," "us," or "our").

2. Eligibility

You must be at least thirteen (13) years of age to use BioFit. If you are under eighteen (18) years of age, you confirm that you have obtained verifiable consent from a parent or legal guardian to use the Service. By creating an account, you represent and warrant that you meet these eligibility requirements and that all information you provide is accurate, complete, and current.

3. Account Registration

To access certain features of the Service, you must register for an account. You agree to: (a) provide accurate and complete information when creating your account; (b) maintain the security of your login credentials; (c) promptly update your account information as needed; and (d) accept responsibility for all activities that occur under your account. You may not share your account credentials with others or create multiple accounts for exploitative purposes. We reserve the right to suspend or terminate accounts that violate these requirements.

4. Free Trial

BioFit offers a 14-day free trial for new users. During the trial period, you will have access to all premium features of the Service. At the end of the trial period, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends. You may cancel your trial at any time through your account settings or by contacting us at support@biotrac.org.

5. Subscription and Billing

BioFit operates on a subscription-based model. Current pricing is:

  • Monthly subscription: $9.99 per month
  • Annual subscription: $99.99 per year (approximately 17% savings)

Payment Processing: All payments, billing management, and subscription processing are handled through Polar ("polar.sh"), our third-party payment processor. By subscribing, you agree to Polar's terms of service and privacy policy. BioFit does not directly store or process your payment card information.

Automatic Renewal: Subscriptions automatically renew at the end of each billing period unless canceled. You can manage or cancel your subscription at any time through your account settings or by contacting Polar directly. Cancellations take effect at the end of the current billing period, and you will retain access to the Service until that time.

Price Changes: We reserve the right to modify subscription pricing. Any price changes will take effect at the beginning of your next billing cycle after providing at least 30 days' advance notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

6. Refund Policy

We offer a 7-day money-back guarantee for all new paid subscriptions. If you are not satisfied with the Service, you may request a full refund within 7 days of your initial subscription purchase by contacting us at support@biotrac.org. Refunds will be processed within 5-10 business days and will be credited to the original payment method. This guarantee applies only to initial subscriptions, not renewals. After the 7-day period, all subscription fees are non-refundable except where required by law.

7. Medical Disclaimer and Assumption of Risk

IMPORTANT: BioFit provides general fitness and wellness information for educational purposes only. We do not provide medical advice, diagnosis, or treatment. The content within our Service is not intended to be a substitute for professional medical advice, diagnosis, or treatment.

You acknowledge that physical exercise involves inherent risks, including but not limited to physical injury, illness, or death. You agree to:

  • Consult a qualified healthcare professional before beginning any fitness or nutrition program
  • Immediately stop any exercise that causes pain, discomfort, or dizziness
  • Not use the Service if you have been advised against physical activity by a healthcare provider

By using BioFit, you assume all risks associated with physical exercise and participation in fitness activities. BioFit, BioTrac LLC, and our affiliates shall not be liable for any injuries, health complications, damages, or losses arising from your participation in physical activity or reliance on information provided through the Service.

8. Acceptable Use

You agree not to misuse the Service, including but not limited to:

  • Engaging in any unlawful activity through the Service
  • Sharing, selling, or transferring your account to others
  • Attempting to reverse engineer, decompile, or hack the platform
  • Uploading malicious code, viruses, or harmful content
  • Interfering with or disrupting the Service or our servers
  • Scraping, data mining, or harvesting user data
  • Impersonating any person or entity
  • Using automated systems to access the Service without authorization

BioFit reserves the right to suspend or terminate accounts, remove content, and take legal action against users who violate these Terms at our sole discretion, without prior notice.

9. Intellectual Property

All software, branding, content, designs, graphics, text, and other intellectual property associated with BioFit (collectively, "Our Content") are the exclusive property of BioTrac LLC and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, reproduce, republish, download, display, post, transmit, or sell any of Our Content without our prior written authorization. The BioFit name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of BioTrac LLC or its affiliates.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using BioFit, you consent to the collection and use of your information as described in the Privacy Policy.

11. Limitation of Liability

To the fullest extent permitted by applicable law, BioTrac LLC and its officers, directors, employees, agents, affiliates, and licensors shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or goodwill
  • Personal injury or property damage
  • Any damages resulting from: (a) your access to or use of (or inability to access or use) the Service; (b) any conduct or content of any third party on the Service; (c) any content obtained from the Service; or (d) unauthorized access, use, or alteration of your transmissions or content

This limitation applies regardless of the legal theory (contract, tort, negligence, or otherwise) and even if we have been advised of the possibility of such damages. In no event shall our total liability to you exceed the amount you paid to us, if any, in the twelve (12) months preceding the event giving rise to the liability.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. WE DO NOT WARRANT THAT: (A) THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (B) ANY ERRORS OR DEFECTS WILL BE CORRECTED; (C) THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (D) THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Service with an updated "Last Updated" date. We will make reasonable efforts to notify you of material changes via email or in-app notification. Your continued use of the Service after any modifications constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must discontinue using the Service.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, United States, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in Tennessee. You agree to submit to the personal jurisdiction of such courts and waive any objection to venue in such courts.

15. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, warranty disclaimers, limitations of liability, and indemnification.
